Terms of Service

Please read these Terms carefully before using CasePilot. By registering, you agree to be bound by these Terms.

1. Definitions

“CasePilot” means the web-based SaaS product at casepilot.co.za operated by CasePilot (Pty) Ltd. “Customer” means the business or individual using CasePilot. “Employee Data” means personal information about your employees captured in CasePilot. “Generated Documents” means charge sheets, notices, and other documents produced by CasePilot. “CCMA Bundle” means the compiled evidence bundle exported for CCMA arbitration.

2. What CasePilot Is — and Is Not

CasePilot is a workflow tool. It is NOT a law firm and does not provide legal advice. CasePilot assists with incident capture and classification, procedural document generation, warning tracking, and CCMA bundle assembly.

CasePilot does NOT provide legal advice, guarantee fair outcomes at the CCMA, represent you at any forum, handle retrenchments (s.189 LRA), or handle collective bargaining or union matters.

All Generated Documents include a disclaimer. Consult a qualified labour law practitioner if uncertain.

3. Account Registration

You must provide accurate information, maintain credential confidentiality, and be 18+ and authorised to contract on behalf of your business. One trial per business domain or verified phone number.

4. Subscription and Payment

  • Starter: up to 5 employees — R299/month or R2,990/year.
  • Growth: up to 20 employees — R399/month or R3,990/year.
  • Business: up to 50 employees — R599/month or R5,990/year.
  • CCMA Bundle: R199 per export (transactional, all tiers).
  • Trial: 7 days free, no credit card required.

Payments via PayFast on a recurring basis until cancellation. Annual plans charged upfront — no partial refunds. Cancel anytime from account settings; access continues to end of billing period. Price changes notified 30 days in advance.

5. Acceptable Use

Use CasePilot only for lawful purposes. Do not enter false information about employees, facilitate unfair labour practices, access other customers’ data, reverse-engineer the software, resell access, or impair the service.

6. AI-Assisted Features

AI outputs are assistive and require your review. AI classification does not constitute legal advice. You are responsible for reviewing all Generated Documents before serving them on employees. AI outputs may contain errors — CasePilot does not warrant their accuracy.

7. Your Data and Employee Data

You own all data you input. You are the responsible party under POPIA for Employee Data. You warrant you have a lawful basis to process your employees’ data. We process Employee Data only to provide the CasePilot service.

8. Generated Documents

Generated Documents are workflow aids only. CasePilot does not warrant legal sufficiency. You are responsible for correct service, compliance with the 48-hour rule, and all procedural requirements of the LRA.

9. Data Retention and Deletion

After cancellation: 30 days full access, then suspended, then permanently deleted after 12 months. Contact legal@casepilot.co.za to request earlier deletion.

10. Intellectual Property

CasePilot software, design, templates, and workflow logic are the intellectual property of CasePilot (Pty) Ltd.

11. Limitation of Liability

CasePilot is provided as-is. We are not liable for unfavourable CCMA outcomes, losses from AI-generated content, or indirect damages. Total liability limited to 3 months of subscription fees paid. Nothing limits liability for gross negligence or fraud.

12. Indemnity

You indemnify CasePilot against claims arising from your violation of these Terms, failure to comply with POPIA, false information entered, or disciplinary actions taken using Generated Documents.

13. Service Availability

We aim for 99% uptime, excluding maintenance. No liability for third-party infrastructure failures.

14. Termination

We may suspend or terminate for breach of these Terms. You may cancel at any time. Sections 7, 9, 11, and 12 survive termination.

15. Governing Law

Governed by the laws of the Republic of South Africa.

16. Changes to These Terms

14 days written notice for material changes. Continued use constitutes acceptance.
