Why procedure matters

Most small businesses lose at the CCMA on procedure, not facts. The September 2025 Code of Good Practice: Dismissal (GN 3470, GG 53294, 4 September 2025) is the standard you'll be measured against — every step has a required notice, a required notice period, and a required record. Get the procedure wrong and the substance of the case stops mattering. The CCMA can award up to twelve months' compensation for a procedurally unfair dismissal, even where the misconduct itself was clear.
